省國土資(zi)源廳《關(guan)于全面實(shi)行工業用地(di)招標拍賣掛牌出讓的實(shi)施意見(jian)(試行)》已經省政府同意,現轉發給你們,請結合實(shi)際,認真貫徹(che)執行。

實施意見(試行)

為貫徹落實(shi)《國務院關于加強土(tu)地調控有關問題(ti)的(de)通知》(國發〔2006〕31號)精神,現就我省(sheng)全面實(shi)(shi)行工業用地招標拍賣(mai)掛牌出(chu)讓(rang)提出(chu)如下實(shi)(shi)施(shi)意見:
一、充(chong)分認識全面實行工業用(yong)地招標拍賣掛牌出(chu)讓的(de)重要意義
我省(sheng)人(ren)多地(di)(di)少,經(jing)(jing)(jing)濟(ji)(ji)社會發(fa)展快,土(tu)地(di)(di)供需(xu)矛盾(dun)突出(chu)(chu)。近年來,各(ge)地(di)(di)實(shi)施工(gong)業用(yong)地(di)(di)控制(zhi)(zhi)指標(biao)(biao)(biao)和合同履(lv)約管理(li)制(zhi)(zhi)度,開(kai)展工(gong)業用(yong)地(di)(di)招(zhao)標(biao)(biao)(biao)拍賣掛牌(pai)出(chu)(chu)讓(rang)試點,全(quan)(quan)省(sheng)建設用(yong)地(di)(di)節(jie)約集約利用(yong)水平(ping)逐(zhu)步提高。但是(shi),由于(yu)(yu)(yu)工(gong)業用(yong)地(di)(di)仍以協(xie)議出(chu)(chu)讓(rang)方式(shi)為(wei)(wei)主,一(yi)些地(di)(di)方存在互相壓價出(chu)(chu)讓(rang)工(gong)業用(yong)地(di)(di)的(de)現象,導(dao)致工(gong)業用(yong)地(di)(di)粗(cu)放低(di)效(xiao)利用(yong),不利于(yu)(yu)(yu)全(quan)(quan)省(sheng)經(jing)(jing)(jing)濟(ji)(ji)社會持續快速健康發(fa)展。因此(ci),全(quan)(quan)面實(shi)行工(gong)業用(yong)地(di)(di)招(zhao)標(biao)(biao)(biao)拍賣掛牌(pai)出(chu)(chu)讓(rang),充分發(fa)揮市場配置(zhi)資(zi)(zi)源的(de)基(ji)礎性作用(yong),有利于(yu)(yu)(yu)土(tu)地(di)(di)資(zi)(zi)源的(de)節(jie)約集約利用(yong),有利于(yu)(yu)(yu)促進經(jing)(jing)(jing)濟(ji)(ji)結(jie)構(gou)調整和增長方式(shi)轉變(bian),有利于(yu)(yu)(yu)防(fang)止國(guo)有土(tu)地(di)(di)資(zi)(zi)產流失,是(shi)緩(huan)解建設用(yong)地(di)(di)供需(xu)矛盾(dun)、保障我省(sheng)經(jing)(jing)(jing)濟(ji)(ji)社會發(fa)展合理(li)用(yong)地(di)(di)需(xu)求的(de)根本出(chu)(chu)路和必然(ran)選擇(ze)。各(ge)地(di)(di)、各(ge)部門要以科學發(fa)展觀為(wei)(wei)指導(dao),從戰(zhan)略和全(quan)(quan)局(ju)的(de)高度,統(tong)一(yi)思想(xiang),深(shen)化認(ren)識,全(quan)(quan)力抓好(hao)這項工(gong)作。
二、建立健(jian)全工業(ye)用地招標拍(pai)賣掛(gua)牌(pai)出讓制度
(一)嚴(yan)格工業用(yong)地(di)供應(ying)政策。自國務(wu)院國發(fa)〔2006〕31號文件發布之日(ri)(即2006年9月6日(ri))起(qi),全省所有(you)工(gong)業項目用地(di)一律(lv)以招標拍(pai)賣掛牌方式出讓。符合省國土(tu)資源廳《關(guan)于工(gong)業用地(di)報(bao)批有(you)關(guan)問題(ti)的(de)通(tong)知》(浙土(tu)資發〔2006〕52號)規(gui)定的除外。各地(di)(di)、各部門(men)不得違反規(gui)定干預工(gong)業用地(di)(di)招(zhao)標拍賣掛牌出讓,嚴禁用行政手段指定供地(di)(di)對象(xiang)、供地(di)(di)位置(zhi)、供地(di)(di)面積、供地(di)(di)用途、供地(di)(di)方(fang)式和供地(di)(di)價格(ge)等。
同(tong)時(shi),各地要嚴格執行國(guo)家產(chan)業政策,按照有利于調整(zheng)產(chan)業結(jie)構和優化產(chan)業布局(ju)的(de)原(yuan)則(ze),切實保(bao)障對推進我省產(chan)業結(jie)構調整(zheng)和優化升級(ji)具有重大作用(yong)(yong)的(de)工業項目用(yong)(yong)地需求。
省下達土(tu)地利用年度計劃指(zhi)標時,對重大(da)工(gong)業項(xiang)目集中的地區予以適當傾(qing)斜。嚴禁向淘汰類工(gong)業項(xiang)目提供土(tu)地,從嚴控制限制類工(gong)業項(xiang)目用地。
(二)編制工業用(yong)(yong)地(di)(di)(di)年度供應(ying)計(ji)(ji)劃(hua)(hua)。每年第(di)一季度,市(shi)、縣(xian)(市(shi)、區)國(guo)(guo)土(tu)資(zi)源部門應(ying)會同(tong)發(fa)展改革、經(jing)貿(mao)、建設(she)、規(gui)劃(hua)(hua)、外經(jing)貿(mao)等部門,依據經(jing)濟社(she)會發(fa)展規(gui)劃(hua)(hua)、國(guo)(guo)家產(chan)業政策、土(tu)地(di)(di)(di)利(li)用(yong)(yong)總體(ti)規(gui)劃(hua)(hua)、土(tu)地(di)(di)(di)利(li)用(yong)(yong)年度計(ji)(ji)劃(hua)(hua)、城市(shi)近期建設(she)規(gui)劃(hua)(hua)、年度建設(she)規(gui)劃(hua)(hua)以(yi)及建設(she)用(yong)(yong)地(di)(di)(di)利(li)用(yong)(yong)和土(tu)地(di)(di)(di)市(shi)場(chang)供求狀況等,編制工業用(yong)(yong)地(di)(di)(di)年度供應(ying)計(ji)(ji)劃(hua)(hua),報(bao)經(jing)同(tong)級(ji)(ji)人(ren)民(min)政府批準,并(bing)報(bao)上一級(ji)(ji)國(guo)(guo)土(tu)資(zi)源部門備案,同(tong)時抄送同(tong)級(ji)(ji)相關(guan)部門。各(ge)地(di)(di)(di)應(ying)及時將工業用(yong)(yong)地(di)(di)(di)年度供應(ying)計(ji)(ji)劃(hua)(hua)通過當地(di)(di)(di)土(tu)地(di)(di)(di)有形市(shi)場(chang)、新(xin)聞媒(mei)體(ti)、政府網站(zhan)以(yi)及中國(guo)(guo)土(tu)地(di)(di)(di)市(shi)場(chang)網(www.landchina.com)和(he)省(sheng)國土資(zi)源廳網站向社會公(gong)布。工業用地年度供(gong)應計劃在執行過程(cheng)中經批(pi)準可以作適當調整。
(三)健全工業(ye)用(yong)(yong)地(di)供(gong)應(ying)信息公(gong)示(shi)制度。市(shi)(shi)(shi)、縣(xian)(市(shi)(shi)(shi)、區)國(guo)土資源部門要會同(tong)發(fa)展改革、經貿、建設、規劃、外經貿、環保等(deng)部門,根(gen)據(ju)開(kai)發(fa)區(園區)、城鎮以及(ji)鄉村工業(ye)項(xiang)目投資情況,分階(jie)段將工業(ye)用(yong)(yong)地(di)年度供(gong)應(ying)計劃細(xi)化落實到區位、地(di)段、地(di)塊(kuai),明確相應(ying)的工業(ye)產(chan)業(ye)結構、產(chan)業(ye)類型、投入產(chan)出標(biao)準、規劃控(kong)制及(ji)環保等(deng)指標(biao),分批(pi)制定(ding)具體(ti)工業(ye)用(yong)(yong)地(di)供(gong)應(ying)信息,并根(gen)據(ju)有(you)關法律(lv)法規規定(ding)及(ji)時向社(she)會公(gong)示(shi),接(jie)受(shou)意向用(yong)(yong)地(di)者的用(yong)(yong)地(di)申請。具體(ti)宗地(di)未正(zheng)式實施供(gong)地(di)以前,其(qi)宗地(di)供(gong)應(ying)信息必須在當地(di)土地(di)有(you)形市(shi)(shi)(shi)場、中國(guo)土地(di)市(shi)(shi)(shi)場網(wang)、省國(guo)土資源廳網(wang)站等(deng)指定(ding)場所或媒體(ti)上(shang)公(gong)示(shi),嚴禁各種形式的“暗箱操作”,規避用(yong)(yong)地(di)信息公(gong)示(shi)。
(四)實(shi)施(shi)工(gong)業(ye)用(yong)(yong)(yong)地公開出(chu)讓(rang)制(zhi)度。工(gong)業(ye)用(yong)(yong)(yong)地實(shi)行凈地出(chu)讓(rang),涉及農(nong)(nong)用(yong)(yong)(yong)地轉用(yong)(yong)(yong)的,須按城市分批(pi)次方式報(bao)批(pi)農(nong)(nong)轉用(yong)(yong)(yong)、征收,涉及拆(chai)遷(qian)工(gong)作由市、縣(xian)(市、區)政府負責實(shi)施(shi)。市、縣(xian)(市、區)國土(tu)資源(yuan)部門要會(hui)同發展改革、經(jing)貿、建設、規(gui)劃、外經(jing)貿、環保等(deng)部門共(gong)同擬(ni)訂工(gong)業(ye)用(yong)(yong)(yong)地招標(biao)、拍賣或掛牌出(chu)讓(rang)方案(an)(可(ke)作為具體工(gong)業(ye)項目用(yong)(yong)(yong)地預審(shen)文件),涉及涉外安(an)全(quan)、外匯結(jie)算、林(lin)地及海岸線使用(yong)(yong)(yong)等(deng)事宜,應預先征求國家安(an)全(quan)、外匯管理(li)、林(lin)業(ye)和海洋等(deng)部門意見。出(chu)讓(rang)方案(an)依法(fa)報(bao)經(jing)批(pi)準后,嚴格按照《招標(biao)拍賣掛牌出(chu)讓(rang)國有(you)土(tu)地使用(yong)(yong)(yong)權規(gui)定》(國土(tu)資源(yuan)部11號令)及(ji)《招標(biao)拍賣(mai)掛牌出(chu)讓(rang)國有土(tu)地(di)(di)(di)使用(yong)權(quan)規(gui)(gui)(gui)范(fan)》(試行)規(gui)(gui)(gui)定(ding)的程序(xu)和要求(qiu),由市(shi)、縣國土(tu)資源(yuan)部門組織實施(shi)供地(di)(di)(di)。工(gong)業(ye)用(yong)地(di)(di)(di)招標(biao)拍賣(mai)掛牌出(chu)讓(rang)確定(ding)用(yong)地(di)(di)(di)者后,用(yong)地(di)(di)(di)者憑市(shi)、縣(市(shi)、區)政府土(tu)地(di)(di)(di)出(chu)讓(rang)方案批(pi)準(zhun)文(wen)件、土(tu)地(di)(di)(di)成交確認(ren)書等資料(liao),到發(fa)展改(gai)革、經貿、建設、規(gui)(gui)(gui)劃、外經貿、環保及(ji)工(gong)商等部門,依(yi)法(fa)辦理(li)工(gong)業(ye)項目(mu)立項、建設規(gui)(gui)(gui)劃、環境評估(gu)、企業(ye)登記等有關報(bao)批(pi)工(gong)作。因特殊情況,未能依(yi)法(fa)辦理(li)相(xiang)關報(bao)批(pi)手續的,按有關規(gui)(gui)(gui)定(ding)另行處置擬出(chu)讓(rang)土(tu)地(di)(di)(di)。
工(gong)業(ye)用(yong)地(di)招標(biao)拍賣掛牌出讓(rang)起始(shi)價(jia)(jia)依據土地(di)估價(jia)(jia)結果、產業(ye)政策及土地(di)市場(chang)情況等確定,不得低于國家和省規定的工(gong)業(ye)用(yong)地(di)出讓(rang)最低價(jia)(jia)標(biao)準(zhun);在國家和省有關工(gong)業(ye)用(yong)地(di)出讓(rang)最低價(jia)(jia)標(biao)準(zhun)公布實施之前,不得低于當(dang)地(di)工(gong)業(ye)用(yong)地(di)基準(zhun)地(di)價(jia)(jia)或(huo)標(biao)定地(di)價(jia)(jia)的80%,嚴禁以財政補貼、返還、減免(mian)或變相(xiang)減免(mian)土地(di)出讓金等形(xing)式低(di)價出讓土地(di)。
(五)健全建設用地供應結(jie)果公示(shi)制(zhi)度。在(zai)具體工業項目用地出讓后的10個(ge)工(gong)作日內(nei),國(guo)土資(zi)源部門須將土地受讓(rang)人、位(wei)置、面積、用(yong)途、使用(yong)年限、出(chu)讓(rang)金額及支付(fu)方式等(deng)(deng)信(xin)息(xi)通(tong)過土地有(you)(you)(you)形(xing)市場(chang)、中國(guo)土地市場(chang)網、省國(guo)土資(zi)源廳網站及當地政(zheng)府網站等(deng)(deng)指(zhi)定(ding)場(chang)所或(huo)媒體(ti)向社會(hui)公(gong)布。對工(gong)業用(yong)地出(chu)讓(rang)后(hou)涉及出(chu)讓(rang)合(he)同有(you)(you)(you)關條款(kuan)約(yue)定(ding)內(nei)容需要調整(zheng)的(de),必須及時將調整(zheng)內(nei)容及理由在指(zhi)定(ding)場(chang)所或(huo)媒體(ti)上(shang)公(gong)開發(fa)布,接(jie)受社會(hui)監督。公(gong)示(shi)無異議(yi)的(de),經有(you)(you)(you)批(pi)準(zhun)權的(de)人民政(zheng)府批(pi)準(zhun)后(hou)可以調整(zheng)土地出(chu)讓(rang)合(he)同有(you)(you)(you)關條款(kuan)約(yue)定(ding)內(nei)容。
(六)加大工業用(yong)地開發(fa)利用(yong)監管(guan)力度。要按照國(guo)土(tu)(tu)資(zi)源部、國(guo)家(jia)工商總局《關于(yu)發(fa)布〈國(guo)有土(tu)(tu)地使用(yong)權出讓(rang)合同補充協議(yi)〉示范文本(ben)(試行)的(de)通知》(國(guo)土(tu)(tu)資(zi)發(fa)〔2006〕83號(hao))和省國土資源廳、省工商局《關于發(fa)布〈國有土地(di)使(shi)用權出(chu)讓合同〉補充條款(工業(ye)建設項目)的通知》(浙土資發(fa)〔2005〕41號)要求,通過土(tu)地(di)(di)出讓合(he)同(tong)補充協議(yi)或附件(jian)條款形(xing)式(shi),對工業項目開(kai)竣工期(qi)限、投資強度(du)、利用(yong)(yong)強度(du)、閑(xian)置標準(zhun)、整體或分割(ge)轉讓條件(jian)、違約(yue)責任和賠償標準(zhun)等事項進行約(yue)定,嚴(yan)格工業用(yong)(yong)地(di)(di)開(kai)發(fa)利用(yong)(yong)管理,建立土(tu)地(di)(di)開(kai)發(fa)利用(yong)(yong)動態監管機制。國(guo)土(tu)資源(yuan)部(bu)門要會同(tong)有(you)關(guan)部(bu)門加強對土(tu)地(di)(di)出讓合(he)同(tong)實施情況的(de)(de)監督檢查,加大對土(tu)地(di)(di)利用(yong)(yong)違約(yue)責任的(de)(de)追究力度(du),切實減少土(tu)地(di)(di)低效利用(yong)(yong)和隱性浪費現象(xiang)的(de)(de)發(fa)生。綜合(he)運用(yong)(yong)經濟、法律和行政等手(shou)段處(chu)置閑(xian)置土(tu)地(di)(di),對因用(yong)(yong)地(di)(di)者自身原因造成國(guo)有(you)土(tu)地(di)(di)有(you)償使用(yong)(yong)合(he)同(tong)約(yue)定開(kai)工之日起(qi)滿1年未動工開(kai)發建設的(de),以及已動工開(kai)發建設但(dan)開(kai)發建設的(de)面(mian)積占應(ying)動工開(kai)發建設總面(mian)積不足(zu)1/3、或者(zhe)已投(tou)資額(e)占總投(tou)資額(e)不足25%且未經批(pi)準中止開發(fa)建(jian)設(she)連續滿1年的(de),國土資(zi)源部門要責成用地(di)者繳納相當于土地(di)出讓金20%的土(tu)地閑置費,并責(ze)令其(qi)限期復(fu)建(jian);對逾期不復(fu)建(jian)或滿2年未動(dong)工建(jian)設(she)的,應依法收(shou)回土地(di)使用權。
(七)引(yin)(yin)導多層標(biao)(biao)(biao)(biao)準(zhun)(zhun)工(gong)(gong)業(ye)(ye)廠(chang)(chang)(chang)房(fang)建(jian)(jian)(jian)設。各(ge)地(di)(di)(di)(di)要結合實際(ji)制定(ding)配套政策,做好標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)建(jian)(jian)(jian)設發展規劃(hua),規范標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)建(jian)(jian)(jian)設和經(jing)(jing)營(ying),引(yin)(yin)導各(ge)類開發企(qi)業(ye)(ye)投資(zi)建(jian)(jian)(jian)造工(gong)(gong)業(ye)(ye)標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang),促(cu)進(jin)(jin)社(she)(she)會資(zi)金進(jin)(jin)入標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)建(jian)(jian)(jian)設領域。加強產業(ye)(ye)投資(zi)引(yin)(yin)導,鼓勵投資(zi)規范和用(yong)(yong)(yong)地(di)(di)(di)(di)面積(ji)較小的項目進(jin)(jin)駐標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)。市、縣(市、區)國土資(zi)源部門要根據本(ben)地(di)(di)(di)(di)區經(jing)(jing)濟社(she)(she)會發展及用(yong)(yong)(yong)地(di)(di)(di)(di)需求狀況,在工(gong)(gong)業(ye)(ye)用(yong)(yong)(yong)地(di)(di)(di)(di)供應計(ji)劃(hua)中安(an)(an)排一(yi)定(ding)比(bi)例用(yong)(yong)(yong)地(di)(di)(di)(di)專項用(yong)(yong)(yong)于標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)建(jian)(jian)(jian)設。工(gong)(gong)業(ye)(ye)標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)用(yong)(yong)(yong)地(di)(di)(di)(di)除農村(cun)(cun)集體經(jing)(jing)濟組織利用(yong)(yong)(yong)村(cun)(cun)級(ji)安(an)(an)置(zhi)留(liu)地(di)(di)(di)(di)建(jian)(jian)(jian)設可(ke)辦理使用(yong)(yong)(yong)手續外(wai),一(yi)律采用(yong)(yong)(yong)招標(biao)(biao)(biao)(biao)拍賣(mai)掛牌出讓方式供應。嚴禁以建(jian)(jian)(jian)設標(biao)(biao)(biao)(biao)準(zhun)(zhun)廠(chang)(chang)(chang)房(fang)為名,違法炒賣(mai)工(gong)(gong)業(ye)(ye)廠(chang)(chang)(chang)房(fang)。
三、切實加強對工業用地招標拍賣掛牌出讓工作的領導
各地(di)、各部門要統一認識(shi),加(jia)強領導,確保(bao)工業用地(di)招(zhao)標拍賣掛(gua)牌出(chu)讓(rang)工作順利推(tui)進。要積(ji)極創造條(tiao)件,加(jia)大(da)工作力度,加(jia)快(kuai)配(pei)套改革,結合本地(di)實(shi)際(ji)制定(ding)完(wan)善(shan)具(ju)體措(cuo)施(shi)。
發展改革、經貿(mao)、科(ke)技、監察、國土資源、建設(she)、規(gui)劃、外(wai)經貿(mao)、環保、工商(shang)等部(bu)門(men)要各司其(qi)職,密切配合,形成合力,共同做(zuo)好工業用地招標拍賣掛牌出讓工作。
