為(wei)貫徹落實《國務(wu)院關(guan)于加強土地(di)調(diao)控有關(guan)問題的通知》(國發〔200631號(hao))精神,現就(jiu)我省全面實行工業用地招(zhao)標拍賣掛牌出讓提出如下(xia)實施意見:

一、充分(fen)認(ren)識全(quan)面實行工(gong)業用地招標拍賣(mai)掛牌出讓的重要意義

我(wo)省(sheng)(sheng)(sheng)人多地(di)(di)少,經(jing)濟社會發展快(kuai),土(tu)地(di)(di)供(gong)需矛(mao)盾(dun)突出(chu)。近年來,各(ge)地(di)(di)實(shi)施工(gong)業(ye)用(yong)(yong)(yong)地(di)(di)控制(zhi)指(zhi)標和(he)合同履約(yue)(yue)(yue)管(guan)理(li)制(zhi)度,開展工(gong)業(ye)用(yong)(yong)(yong)地(di)(di)招標拍賣(mai)掛牌出(chu)讓(rang)試(shi)點,全省(sheng)(sheng)(sheng)建設(she)用(yong)(yong)(yong)地(di)(di)節約(yue)(yue)(yue)集約(yue)(yue)(yue)利(li)用(yong)(yong)(yong)水平逐步提高。但是,由于工(gong)業(ye)用(yong)(yong)(yong)地(di)(di)仍以協議出(chu)讓(rang)方式為(wei)主(zhu),一些地(di)(di)方存在(zai)互相(xiang)壓(ya)價出(chu)讓(rang)工(gong)業(ye)用(yong)(yong)(yong)地(di)(di)的(de)現象(xiang),導致工(gong)業(ye)用(yong)(yong)(yong)地(di)(di)粗放低效利(li)用(yong)(yong)(yong),不利(li)于全省(sheng)(sheng)(sheng)經(jing)濟社會持續快(kuai)速健康發展。因(yin)此,全面實(shi)行工(gong)業(ye)用(yong)(yong)(yong)地(di)(di)招標拍賣(mai)掛牌出(chu)讓(rang),充分(fen)發揮市(shi)場配(pei)置(zhi)資(zi)源的(de)基礎性作用(yong)(yong)(yong),有利(li)于土(tu)地(di)(di)資(zi)源的(de)節約(yue)(yue)(yue)集約(yue)(yue)(yue)利(li)用(yong)(yong)(yong),有利(li)于促進經(jing)濟結構調整和(he)增長方式轉變,有利(li)于防止(zhi)國有土(tu)地(di)(di)資(zi)產流失,是緩解建設(she)用(yong)(yong)(yong)地(di)(di)供(gong)需矛(mao)盾(dun)、保(bao)障我(wo)省(sheng)(sheng)(sheng)經(jing)濟社會發展合理(li)用(yong)(yong)(yong)地(di)(di)需求(qiu)的(de)根本出(chu)路(lu)和(he)必(bi)然選擇。各(ge)地(di)(di)、各(ge)部門要以科學發展觀為(wei)指(zhi)導,從戰略和(he)全局的(de)高度,統一思想,深化認識,全力(li)抓(zhua)好這項工(gong)作。

二、建立(li)健全工業用地招標拍賣掛牌出讓制(zhi)度

(一)嚴格工業用(yong)地供(gong)應政策。自(zi)國務(wu)院(yuan)國發〔200631號文件發布之日(即200696日(ri))起,全省所有(you)工(gong)業(ye)項目用地一律以招標拍賣掛牌方(fang)式出讓。符合省國(guo)土(tu)資源廳《關于工(gong)業(ye)用地報批(pi)有(you)關問題的通知》(浙土(tu)資發〔200652號)規(gui)(gui)定(ding)(ding)的(de)除外。各(ge)地(di)(di)(di)、各(ge)部(bu)門不得違反規(gui)(gui)定(ding)(ding)干預工(gong)業用(yong)地(di)(di)(di)招標拍賣掛牌(pai)出讓(rang),嚴禁用(yong)行政手段指定(ding)(ding)供(gong)(gong)(gong)地(di)(di)(di)對象、供(gong)(gong)(gong)地(di)(di)(di)位(wei)置、供(gong)(gong)(gong)地(di)(di)(di)面積(ji)、供(gong)(gong)(gong)地(di)(di)(di)用(yong)途(tu)、供(gong)(gong)(gong)地(di)(di)(di)方式和供(gong)(gong)(gong)地(di)(di)(di)價格等。

同時(shi),各(ge)地要嚴格執(zhi)行國家產(chan)(chan)業政策(ce),按照有利于(yu)調(diao)整產(chan)(chan)業結構和(he)優(you)化(hua)產(chan)(chan)業布局的(de)原則,切實保障對推進我省產(chan)(chan)業結構調(diao)整和(he)優(you)化(hua)升級具有重大作用(yong)的(de)工業項目(mu)用(yong)地需求(qiu)。

省下達土地(di)利用年度計劃指(zhi)標時,對重(zhong)大工業項(xiang)目集中的地(di)區(qu)予以適當傾斜。嚴禁向(xiang)淘汰類工業項(xiang)目提供(gong)土地(di),從(cong)嚴控制限制類工業項(xiang)目用地(di)。

(二)編制工業(ye)用(yong)地(di)(di)(di)年(nian)(nian)(nian)度供(gong)應(ying)(ying)計(ji)(ji)劃。每年(nian)(nian)(nian)第一(yi)季(ji)度,市(shi)、縣(市(shi)、區)國(guo)土資源(yuan)部門應(ying)(ying)會(hui)同(tong)發展改革、經(jing)(jing)貿、建(jian)設(she)、規(gui)(gui)劃、外經(jing)(jing)貿等部門,依據經(jing)(jing)濟(ji)社會(hui)發展規(gui)(gui)劃、國(guo)家產(chan)業(ye)政(zheng)(zheng)策、土地(di)(di)(di)利用(yong)總體(ti)(ti)規(gui)(gui)劃、土地(di)(di)(di)利用(yong)年(nian)(nian)(nian)度計(ji)(ji)劃、城市(shi)近期建(jian)設(she)規(gui)(gui)劃、年(nian)(nian)(nian)度建(jian)設(she)規(gui)(gui)劃以及建(jian)設(she)用(yong)地(di)(di)(di)利用(yong)和土地(di)(di)(di)市(shi)場供(gong)求(qiu)狀況等,編制工業(ye)用(yong)地(di)(di)(di)年(nian)(nian)(nian)度供(gong)應(ying)(ying)計(ji)(ji)劃,報經(jing)(jing)同(tong)級(ji)(ji)人民政(zheng)(zheng)府批準,并(bing)報上一(yi)級(ji)(ji)國(guo)土資源(yuan)部門備(bei)案(an),同(tong)時(shi)抄送同(tong)級(ji)(ji)相關部門。各地(di)(di)(di)應(ying)(ying)及時(shi)將工業(ye)用(yong)地(di)(di)(di)年(nian)(nian)(nian)度供(gong)應(ying)(ying)計(ji)(ji)劃通過當地(di)(di)(di)土地(di)(di)(di)有(you)形市(shi)場、新聞媒體(ti)(ti)、政(zheng)(zheng)府網(wang)站以及中國(guo)土地(di)(di)(di)市(shi)場網(wang)(www.landchina.com)和省國土資源廳(ting)網(wang)站(zhan)向社會公布。工業用地年度供應計劃在執行過程(cheng)中經批準可(ke)以作適當(dang)調(diao)整。

(三)健(jian)全工(gong)(gong)業(ye)(ye)用地(di)(di)供應信息公(gong)(gong)示(shi)制(zhi)度。市(shi)、縣(市(shi)、區(qu))國土(tu)資(zi)源部(bu)門要會(hui)同發展改革、經貿、建設(she)、規劃、外經貿、環(huan)保(bao)等(deng)部(bu)門,根(gen)(gen)據開發區(qu)(園區(qu))、城鎮以及鄉村工(gong)(gong)業(ye)(ye)項目投資(zi)情況(kuang),分階段將工(gong)(gong)業(ye)(ye)用地(di)(di)年度供應計劃細化落實(shi)到區(qu)位、地(di)(di)段、地(di)(di)塊,明確相應的工(gong)(gong)業(ye)(ye)產(chan)業(ye)(ye)結構、產(chan)業(ye)(ye)類(lei)型、投入產(chan)出標準、規劃控制(zhi)及環(huan)保(bao)等(deng)指(zhi)標,分批制(zhi)定(ding)具(ju)體(ti)工(gong)(gong)業(ye)(ye)用地(di)(di)供應信息,并根(gen)(gen)據有(you)關法律法規規定(ding)及時(shi)向社會(hui)公(gong)(gong)示(shi),接受意向用地(di)(di)者的用地(di)(di)申請。具(ju)體(ti)宗地(di)(di)未正式實(shi)施供地(di)(di)以前,其宗地(di)(di)供應信息必須在當地(di)(di)土(tu)地(di)(di)有(you)形市(shi)場(chang)、中國土(tu)地(di)(di)市(shi)場(chang)網、省(sheng)國土(tu)資(zi)源廳網站等(deng)指(zhi)定(ding)場(chang)所或媒(mei)體(ti)上公(gong)(gong)示(shi),嚴禁各(ge)種(zhong)形式的“暗(an)箱操(cao)作”,規避用地(di)(di)信息公(gong)(gong)示(shi)。

(四)實施工業(ye)(ye)用(yong)(yong)(yong)地公開出(chu)(chu)(chu)讓(rang)(rang)(rang)制度。工業(ye)(ye)用(yong)(yong)(yong)地實行凈地出(chu)(chu)(chu)讓(rang)(rang)(rang),涉及(ji)農用(yong)(yong)(yong)地轉用(yong)(yong)(yong)的,須按城市分批次方式報(bao)批農轉用(yong)(yong)(yong)、征(zheng)收,涉及(ji)拆遷工作(zuo)由市、縣(市、區(qu))政府負責實施。市、縣(市、區(qu))國土資源部(bu)門(men)要會同發(fa)展改革、經(jing)(jing)貿、建設、規(gui)劃、外(wai)(wai)經(jing)(jing)貿、環保等部(bu)門(men)共同擬訂工業(ye)(ye)用(yong)(yong)(yong)地招標(biao)、拍賣(mai)或掛(gua)牌出(chu)(chu)(chu)讓(rang)(rang)(rang)方案(an)(an)(可(ke)作(zuo)為具體(ti)工業(ye)(ye)項目(mu)用(yong)(yong)(yong)地預審(shen)文(wen)件(jian)),涉及(ji)涉外(wai)(wai)安全、外(wai)(wai)匯結算、林(lin)(lin)地及(ji)海岸線(xian)使(shi)用(yong)(yong)(yong)等事(shi)宜,應預先征(zheng)求國家(jia)安全、外(wai)(wai)匯管(guan)理、林(lin)(lin)業(ye)(ye)和(he)海洋(yang)等部(bu)門(men)意見(jian)。出(chu)(chu)(chu)讓(rang)(rang)(rang)方案(an)(an)依法報(bao)經(jing)(jing)批準后,嚴(yan)格按照(zhao)《招標(biao)拍賣(mai)掛(gua)牌出(chu)(chu)(chu)讓(rang)(rang)(rang)國有(you)土地使(shi)用(yong)(yong)(yong)權規(gui)定》(國土資源部(bu)11號令)及《招(zhao)標(biao)拍賣掛(gua)牌出(chu)(chu)讓(rang)(rang)國(guo)有(you)土地(di)(di)(di)(di)使用權規(gui)(gui)(gui)范》(試行)規(gui)(gui)(gui)定(ding)的(de)程序和要求(qiu),由(you)市(shi)、縣(xian)(xian)國(guo)土資(zi)源部門組織(zhi)實施供地(di)(di)(di)(di)。工(gong)(gong)業(ye)用地(di)(di)(di)(di)招(zhao)標(biao)拍賣掛(gua)牌出(chu)(chu)讓(rang)(rang)確(que)定(ding)用地(di)(di)(di)(di)者后,用地(di)(di)(di)(di)者憑(ping)市(shi)、縣(xian)(xian)(市(shi)、區)政府土地(di)(di)(di)(di)出(chu)(chu)讓(rang)(rang)方案批(pi)準文件、土地(di)(di)(di)(di)成交(jiao)確(que)認書等資(zi)料,到發展(zhan)改革、經(jing)(jing)貿(mao)(mao)、建(jian)設(she)、規(gui)(gui)(gui)劃(hua)、外(wai)經(jing)(jing)貿(mao)(mao)、環(huan)保及工(gong)(gong)商(shang)等部門,依法(fa)辦理工(gong)(gong)業(ye)項目立項、建(jian)設(she)規(gui)(gui)(gui)劃(hua)、環(huan)境(jing)評估、企業(ye)登記等有(you)關(guan)報批(pi)工(gong)(gong)作(zuo)。因(yin)特殊情況(kuang),未能依法(fa)辦理相關(guan)報批(pi)手續的(de),按有(you)關(guan)規(gui)(gui)(gui)定(ding)另行處置擬出(chu)(chu)讓(rang)(rang)土地(di)(di)(di)(di)。

工業用(yong)(yong)地(di)(di)招標(biao)拍賣掛牌出(chu)讓(rang)起始價(jia)依據土(tu)(tu)地(di)(di)估價(jia)結(jie)果、產業政策(ce)及(ji)土(tu)(tu)地(di)(di)市場情(qing)況等確定(ding),不(bu)得低(di)于國家(jia)和(he)省(sheng)規定(ding)的(de)工業用(yong)(yong)地(di)(di)出(chu)讓(rang)最(zui)低(di)價(jia)標(biao)準(zhun);在國家(jia)和(he)省(sheng)有關工業用(yong)(yong)地(di)(di)出(chu)讓(rang)最(zui)低(di)價(jia)標(biao)準(zhun)公布實(shi)施(shi)之前,不(bu)得低(di)于當地(di)(di)工業用(yong)(yong)地(di)(di)基準(zhun)地(di)(di)價(jia)或標(biao)定(ding)地(di)(di)價(jia)的(de)80%,嚴禁以財政補(bu)貼、返還、減免或變相(xiang)減免土地(di)出讓金等形式(shi)低價出讓土地(di)。

(五)健全建設用(yong)地(di)(di)供應(ying)結(jie)果公示(shi)制度。在具體(ti)工(gong)業項目用(yong)地(di)(di)出讓后的10個(ge)工(gong)作日內,國(guo)土(tu)(tu)資(zi)源(yuan)部門(men)須將(jiang)土(tu)(tu)地(di)受(shou)讓(rang)(rang)人(ren)、位置、面積、用途、使用年限、出讓(rang)(rang)金額(e)及(ji)支付方式(shi)等信(xin)息通過土(tu)(tu)地(di)有(you)(you)形市(shi)(shi)場(chang)、中國(guo)土(tu)(tu)地(di)市(shi)(shi)場(chang)網、省國(guo)土(tu)(tu)資(zi)源(yuan)廳(ting)網站及(ji)當地(di)政府網站等指定(ding)場(chang)所(suo)或媒體向社會公(gong)布。對工(gong)業用地(di)出讓(rang)(rang)后涉(she)及(ji)出讓(rang)(rang)合同(tong)有(you)(you)關條款約定(ding)內容需要調(diao)整的,必(bi)須及(ji)時將(jiang)調(diao)整內容及(ji)理由在指定(ding)場(chang)所(suo)或媒體上公(gong)開發(fa)布,接(jie)受(shou)社會監督。公(gong)示無異議的,經有(you)(you)批準權的人(ren)民政府批準后可(ke)以調(diao)整土(tu)(tu)地(di)出讓(rang)(rang)合同(tong)有(you)(you)關條款約定(ding)內容。

(六)加大工(gong)業用(yong)(yong)地(di)(di)開(kai)發利用(yong)(yong)監管力度(du)。要按照國(guo)土資(zi)源部(bu)、國(guo)家工(gong)商總局《關(guan)于(yu)發布〈國(guo)有土地(di)(di)使用(yong)(yong)權出讓合同補充(chong)協(xie)議〉示范(fan)文本(試行)的通知》(國(guo)土資(zi)發〔200683號)和省(sheng)(sheng)國土資源廳、省(sheng)(sheng)工商(shang)局《關于發布〈國有土地使用權出讓合(he)同〉補充條款(工業建設項目)的(de)通知》(浙土資發〔200541號)要求,通過土(tu)地(di)出(chu)讓合同補充協議或附件(jian)條款形(xing)式,對工(gong)業項目開竣工(gong)期限、投資(zi)強(qiang)度(du)、利(li)(li)用強(qiang)度(du)、閑(xian)置標準、整體(ti)或分割(ge)轉(zhuan)讓條件(jian)、違(wei)約責任和賠償(chang)(chang)標準等事項進行約定,嚴格工(gong)業用地(di)開發利(li)(li)用管(guan)理(li),建立土(tu)地(di)開發利(li)(li)用動態(tai)監管(guan)機制。國(guo)土(tu)資(zi)源部門(men)要會(hui)同有關部門(men)加強(qiang)對土(tu)地(di)出(chu)讓合同實(shi)施情況的(de)監督檢查,加大對土(tu)地(di)利(li)(li)用違(wei)約責任的(de)追究力度(du),切實(shi)減少土(tu)地(di)低效利(li)(li)用和隱性浪費現象的(de)發生。綜合運用經濟(ji)、法律和行政等手段處(chu)置閑(xian)置土(tu)地(di),對因用地(di)者(zhe)自身原因造成國(guo)有土(tu)地(di)有償(chang)(chang)使用合同約定開工(gong)之(zhi)日起滿1年(nian)未動工(gong)開(kai)發建設(she)(she)(she)(she)的,以及已動工(gong)開(kai)發建設(she)(she)(she)(she)但開(kai)發建設(she)(she)(she)(she)的面積(ji)占(zhan)應動工(gong)開(kai)發建設(she)(she)(she)(she)總面積(ji)不足(zu)1/3、或者(zhe)已投資額占(zhan)總投資額不足25%且未經批準中止開發建設連續滿1年的(de),國(guo)土資源(yuan)部門要責成用(yong)地(di)者(zhe)繳(jiao)納相當于(yu)土地(di)出讓金20%的土地閑置(zhi)費,并(bing)責令其(qi)限(xian)期復(fu)建;對逾(yu)期不復(fu)建或滿2年未動工建設(she)的,應依法收回土(tu)地使用(yong)權(quan)。

(七)引導多層標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)工業(ye)(ye)廠房(fang)(fang)建設(she)(she)。各地(di)(di)(di)要(yao)結合實際制(zhi)定(ding)配套政策,做好(hao)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)建設(she)(she)發展規(gui)劃,規(gui)范(fan)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)建設(she)(she)和經營,引導各類開(kai)發企業(ye)(ye)投資(zi)建造工業(ye)(ye)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang),促進(jin)社會(hui)資(zi)金進(jin)入(ru)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)建設(she)(she)領(ling)域。加強(qiang)產業(ye)(ye)投資(zi)引導,鼓勵投資(zi)規(gui)范(fan)和用(yong)地(di)(di)(di)面積較(jiao)小的項目進(jin)駐標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)。市、縣(市、區(qu))國(guo)土資(zi)源部(bu)門要(yao)根據本地(di)(di)(di)區(qu)經濟社會(hui)發展及用(yong)地(di)(di)(di)需求狀(zhuang)況,在工業(ye)(ye)用(yong)地(di)(di)(di)供(gong)應計(ji)劃中安排一(yi)定(ding)比例用(yong)地(di)(di)(di)專項用(yong)于標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)建設(she)(she)。工業(ye)(ye)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)用(yong)地(di)(di)(di)除農(nong)村(cun)集體經濟組織利用(yong)村(cun)級(ji)安置(zhi)留(liu)地(di)(di)(di)建設(she)(she)可辦理使用(yong)手續外(wai),一(yi)律采(cai)用(yong)招標(biao)(biao)拍賣掛牌出讓方式供(gong)應。嚴禁以建設(she)(she)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)廠房(fang)(fang)為名(ming),違法(fa)炒賣工業(ye)(ye)廠房(fang)(fang)。

三(san)、切實加強(qiang)對工業用地招標拍(pai)賣掛牌(pai)出(chu)讓工作的領導(dao)

各地(di)(di)、各部(bu)門要統一認識(shi),加強領導,確保工(gong)業用地(di)(di)招標(biao)拍賣掛牌出讓工(gong)作順(shun)利推進。要積極(ji)創(chuang)造條件,加大(da)工(gong)作力度,加快配套改革(ge),結合(he)本(ben)地(di)(di)實際制定完善(shan)具(ju)體(ti)措施。

發展改革、經貿(mao)、科技、監察(cha)、國土(tu)資源(yuan)、建設、規劃、外經貿(mao)、環保、工商等部門要各(ge)司其職,密(mi)切(qie)配合(he),形成合(he)力,共(gong)同(tong)做好(hao)工業用地招標拍賣掛牌出讓工作。
